Please read these Terms & Conditions carefully before using DineHub. By registering or using our platform, you agree to be bound by these terms.
1. About DineHub
DineHub is a restaurant management software platform ("Platform") developed and operated by The Digital Hype, a digital marketing and technology agency based in Mumbai, India (contact: thedigitalhype2.0@gmail.com, +91 87798 49621).
The Platform provides point-of-sale (POS) billing, loyalty program management, marketing tools, reporting, kitchen order management, and related services to restaurant businesses ("Clients").
2. Eligibility
To use DineHub you must:
- Be a registered business entity or individual operating a lawful food service establishment in India
- Be at least 18 years of age
- Provide accurate and complete registration information
- Have the legal authority to enter into these terms on behalf of your business
3. Subscription & Payment
3.1 Plans
DineHub offers three subscription plans — Starter (₹999/month), Growth (₹1,999/month), and Pro (₹3,499/month). All prices are exclusive of applicable GST.
3.2 Free Trial
All plans include a 30-day free trial period. No charges are applied during the trial. After the trial, your selected plan will be billed monthly.
3.3 Payment Processing
Payments are processed securely through Razorpay (razorpay.com). The Digital Hype does not store your card or bank account details. By making a payment, you also agree to Razorpay's Terms of Service.
3.4 Billing Cycle
Subscriptions are billed monthly from the date your trial ends or your plan activates. Failed payments may result in suspension of access until payment is resolved.
4. Refund & Cancellation
Please refer to our separate Refund & Cancellation Policy for complete details. In summary:
- You may cancel your subscription at any time from Settings → Plans
- Cancellation takes effect at the end of the current billing period
- Refunds are available within 7 days of a charge if you have not used the paid features
- Trial periods are free and require no cancellation
5. Permitted Use
You may use DineHub solely for legitimate restaurant management operations including billing customers, managing your menu, tracking loyalty, sending marketing communications to your own customer base with their consent, and generating reports for your business.
You must not:
- Use DineHub to process fraudulent transactions or bill non-existent customers
- Reverse engineer, copy, resell, or create derivative products from the Platform
- Send unsolicited marketing messages (spam) to customers who have not consented
- Attempt to gain unauthorised access to other tenants' data
- Use the Platform to violate any applicable law including GST laws, TRAI DLT regulations, PDPB 2023, or Consumer Protection Act
- Share your login credentials with persons outside your business
6. Data & Privacy
Your restaurant's data and your customers' data stored in DineHub belongs to you. We do not sell or share your data with third parties for advertising or commercial purposes. Please see our Privacy Policy for full details on how we collect, store, and protect data.
7. GST & Tax Compliance
DineHub provides GST calculation tools for reference purposes only. The GST figures shown are estimates based on the rates you configure. You are solely responsible for verifying tax calculations with a qualified Chartered Accountant before filing returns. The Digital Hype and DineHub are not liable for any tax filing errors, penalties, or liabilities arising from reliance on information displayed on the Platform.
8. WhatsApp & Email Marketing
If you use DineHub's marketing features, you are responsible for:
- Obtaining valid, documented consent from customers before sending marketing messages
- Complying with TRAI DLT registration requirements for SMS marketing
- Complying with Meta's WhatsApp Business Policy for WhatsApp campaigns
- Maintaining an opt-out mechanism for marketing communications
The Digital Hype is not responsible for regulatory violations arising from your marketing campaigns.
9. Uptime & Service Availability
We strive for 99% platform availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible. We are not liable for business losses arising from platform downtime, including but not limited to lost sales, billing delays, or data inaccessibility.
10. Limitation of Liability
To the maximum extent permitted by applicable law, The Digital Hype's total liability to you for any claims arising from use of DineHub shall not exceed the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.
11. Account Termination
We may suspend or terminate your account immediately if:
- You breach any provision of these Terms
- Your payment fails and remains unresolved after 7 days
- We are required to do so by law
- Your subscription expires and is not renewed
On termination, your data will be retained for 30 days and then deleted unless you request export beforehand.
12. Modifications to Terms
We reserve the right to update these Terms at any time. We will notify you by email or in-app notification at least 7 days before material changes take effect. Continued use after the effective date constitutes acceptance of updated Terms.
13. Governing Law & Disputes
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra. We encourage resolving disputes through direct communication first — contact us at thedigitalhype2.0@gmail.com or +91 87798 49621.
